Minnesota has a process for expunging criminal convictions so that they no longer appear on background checks and you are allowed to answer questions that you have not been convicted.

Are you eligible for Expungement?

Not every conviction is eligible for an expungement. A conviction can only be expunged if you meet one of the following situations:



  1. If you were charged with a crime that was later dismissed or that you were found not guilty of, you are immediately eligible for an expungement after the dismissal or not guilty verdict.
  2. If you were convicted of a crime but received a stay of adjudication or participated in a diversion program, you are eligible for expungement as long as you have not been charged with a new crime for at least one year since the completion of the stay of adjudication or diversion program.
  3. If you were convicted of a petty misdemeanor or misdemeanor, then you are eligible for expungement as long as two years have passed since discharge from the sentence of the crime and you have not been convicted of a new crime.
  4. If you were convicted of a gross misdemeanor, then you are eligible for expungement as long as four years have passed since you were discharged from the sentence of the crime, and you have not been convicted of a new crime.
  5. If you were convicted of a felony, you are only eligible if the crime is one of fifty that is authorized to be expunged, and you have not been convicted of a new crime for at least five years after being discharged from the sentence of the crime.
